Menilik Kepentingan Publik Dalam Undang Undang Mineral Dan Batubara (Minerba) Terkait Dengan Penerapan Domestic Market Obligation (DMO) Di Indonesia
Abstract
Indonesia is a country with abundant natural resources. Various areas in Indonesia contain minerals, coal, and precious metals and other minerals. The 1945 Constitution article 33, explains that The State controls all natural wealth found and produced in Indonesia and exploits them for the sake of the people’s welfare. One interpretation of the Article is that regarding coal mining.Several laws and regulations on coal mining have been issued, one of which is the policy on Domestic Market Obligation (DMO). The policy says that coal producers are obliged to give priority to the needs fulfillment of domestic industries’. Implementation of this policy can be viewed in two perspectives; those are of the coal producers’ and of the consumers. Their interests must be accommodated fairly by the government; however publik interests must become the main priority.
